Legal Question in Family Law in Maryland

My husband and I are still living together due to lease terms. I am scared he is going to leave with out 16 month old son. Can I file for temporary custody of our son even though we still live together and him not know?

Your husband would have to be notified of the filing for custody, whether is was in connection with a divorce or custody filing or associated with a protective order.
