A co-owner of real property can bring a lawsuit called a partition action to force the sale of the property. The use of the property by the other co-owner is irrelevant. In your situation, if at all possible you should try to buy out the ex-husband's interest in the property, as that would be much less expensive than going through a partition lawsuit. If there is any equity in the property you could perhaps qualify for a new loan yielding enough cash to accomplish this.
