how to get my husband to move out

Can I evict my husband before the divorce. I owned my home prior to our union. I can not wait til the divorce I want him out my house asap.( he has not been violent, he just refuse to pay any bills at all)

If you are the sole owner of the property per the deed, tell him to leave. If he refuses, you could change the locks, but in that situation you ought to ask the police to be present at his expected arrival time at home to prevent potential problems. You might want to check with your local precinct to see if and how they'll assist you. If you have minor children and would seek custody as part of a divorce, you can ask for an order giving you immediate exclusive possession of the marital home as part of the divorce papers.
