Legal Question in Family Law in Maryland

My husband that I am separated from took all of the refund we got from the IRS. Can I sue him for my half of the refund or include it in the divorce settlement so that I can get my money.

The best way to handle this is to include it in the divorce settlement, since it's marital property.
