My husband and I are going through a separation. He took one of the cars that is in my name without my permission. I have been trying to get him to return the car to me because their is no insurance on it anymore, and the tags were due to be renewed(and are now expired). He expects me to hand the title to the car over to him, even after the fact that he has gotten numerous tickets in it and pulled over a couple of times.What should I do? Also, he has told me that he has moved to another state and does not expect to give me my car back.What should I do?

Don't confuse title to the vehicle with the concept of marital property. If the vehicle is titled in your name--even if it is marital property--it is legally yours. The first thing you need to do is locate the vehicle. A private investigator, or "skip tracer," may be able to help with this. If you can locate the car, just go get it. Keep in mind, however, that you cannot trespass or break into private property to recover the car. Once you locate the car, it would be prudent to consult with counsel in the state where the vehicle is now located.
