Legal Question in Family Law in Maryland
Husband had a vasectomy without wife's knowledge
I was told that my husband had a vasectomy. I do not know this for sure. We are currently separated, no papers signed. If he did this without my knowledge, what legal recorse do I have against him? How can I find out without seeing medical records?

Just as marriage is a mutual promise and agreement, so is procreation.
On the other hand, the Equal Rights Amendment and its progeny has had some rather unanticipated results.
Just as a husband cannot force a wife to become pregnant (i.e., stop her from taking the pill) or force her to
bear a child to term (i.e., stop her from getting an abortion), so can a wife not force a husband to donate sperm (i.e., stop him
from getting a vasectomy).
If you do not have a separation agreement, matters over assets, health insurance, retirement benefits, and the like should be addressed. I am a skilled negotiator with reasonable fees for separation agreements.
I do not offer "fill in the blank" separation agreements for $150 as you see in local newspapers, rather the separation agreements that I prepare are tailored to your specific situation and protect your legal rights.

You have the same recourse against your husband that he would have against you if you had decided to have a tubal ligation--none. Everyone has the right to control their own body and to make their own medical decisions, except in very limited circumstances.
