Legal Question in Family Law in Maryland
Get my husbands name off my vehicle
Can I take my ex-husband to small claims court to have his name removed from the Vehicle we purchased together, or Can I have my name removed, and ask for cash that I put down on it to purchase another car? ( He refuses to have his name taken off)

Re: Get my husbands name off my vehicle
I am assuming that the car was purchased while you were still married, but I am puzzled that you got a divorce without issues regarding a jointly owned vehicle were not resolved at the time of divorce. In any case, a jointly owned car is still jointly owned, and presumably only one of you has use and possession of it. If your ex-husband has possession, you might sue him in the District Court if you are denied use of the car. If you have possession, and the car is fully paid for, you might want to continue using it until he becomes willing to negotiate an agreement to take someone's name off the title and compensate that person for money paid for the purchase of the car. As long as both of you are owners, you definitely want your name as a beneficiary on the insurance, and you want to be protected from liability by the insurance policy. Before you go to court, try to resolve this matter in a business like way. If you both paid for the car, and both are owners, you both have a right to use the car. Obviously this is unworkable since your divorce, so one of you needs to be compensated for giving up an interest in the car.
