Income Reporting to Ex-Wife

My ex-wife(custodian of our child) is requesting my 2003,W-2, so she can pursue a child support modification. What are my options? I am uncomfortable with any casual communication or exchange of financial documents with her. Can I just tell her ''no'' and wait for a court order for the modification? We have no formal agreement to disclose financial records.

She often uses finances as a weapon of harassment in her obsessive alienation of the child from me. She will create issues where there are none, just to start trouble and there is no clear way to stop her. On the child support calculation worksheet, the slight increase in my salary is offset by removing the charge for day care which my child no longer attends. She may attempt to claim a lower income because she stopped working when she got remarried five years ago (right after our divorce). She now alternatively works from home and does not work at all.

I would just like to end this before it escalates. At what point will I need an attorney?

You're not under any obligation to turn over financial information absent an agreement to do so. However, if she files for modification, you'll be required to turn over such documents at that time. I suggest you offer to exchange yours for hers now; you'll then be able to determine if she's entitled to an increase in support if you know how to calculate guideline support.

You'd be well advised to seek legal representation to either help negotiate with her or certainly to defend a modification petition. There are legal issues regarding income calculation that an experienced family law attorney will be aware of, which you might overlook.
