Increase in Child Support
My ex-husband doesn't want to pay more child support for our disabled daughter so he and his attorney are doing everything to delay this process. Although our daughter was born disabled, she is mentally retarded with numerous other serious medical problems he and his attorney has said that she isn't and that she is employed, which she is not. I'm now having to respond to a lot of questions concerning my income, what portion is being spent on her, etc. Her doctors and school teacher (she's in special ed/CRI Program and will be graduating this year at the age of 20 and will be transitioning to a state program with the ARC for employment training) have provided information concerning her condition which states that she will never be able to financially care for herself. It has been a year since I stated legal actions however a ruling has yet been made concerning an increase. This is the first time in 10 yrs that I've asked for an increase but because my ex doesn't want to pay he and his attorney are doing everything possible to delay the court hearing. What can I do? My ex an his attorney has stated that she is not disabled and can care for herself but all of this is a lie and they know this. Is there any other recourse?

It sounds like you are trying to handle this on your own, which is a serious mistake. Your ex's attorney is doing his job, by taking discovery from you pertaining to your income and your daughter's expenses. These are significant factors in determining the amount of support your daughter needs. Likewise, you should be requesting documents from your ex pertaining to his current income, such as pay statements and tax returns. You are also entitled to serve interrogatories on him on these issues. You would be smart to retain an experienced family attorney to help you get what the law entitles you to.
