Legal Question in Family Law in Maryland
INS will not accept divorce
Several years ago my 1st wife obtained our divorce from Mexico. I had submitted the paper work for a divorce in California when I received the divorce papers from her. We were both California residents at the time. I took the papers to my lawyer to find out if the were legal and he told me that they were and as a Notary Public he stamped them and marked them as a certified true copy and told me I was divorced. My ex wife remarried in California and I have recently remarried overseas. I took a copy of the divorce papers to the American Consulate and was advised that they would not accept this divorce because it was by proxy. What can I do to rectify this situation? Thank you

Re: INS will not accept divorce
You will need to get a divorce by a county, state, and country that has jurisdiction over your marriage. Most governments agencies will not accept a divorce decree unless the state or country has at least one party a resident. You can get a divorce in the country that you are currently living, if their laws state that they have jurisdiction or you can get a divorce in the county and state that your 1st "wife" is currently living. Then you will need to "remarry" your current wife. Good Luck, Pat McCrary
