Legal Question in Family Law in Maryland

Joining the military

I am a single mom. I already went to court and have been giving some form of custody (the order only says the child is to remain in the custody of her mom and her dad is to enjoy visitation) (not sure if that means i have full custody or what but i live in the state of md. I want to join the army but have to temporarily give custody to someone. I dont want to leave her with her dad. I would rather leave her with my sister? Is there any law the prohibits me from doing so?

Re: Joining the military

Apparently I just answered another version of the same question. Given the information (not clear in the other version) that you apparently have only temporary custody, I agree with Robert Sher, who always answers these questions wisely.

Right now you only have temporary custody if you are in the midst of a divorce, or if not married to the dad, a custody proceeding. While you could give temporary guardianship to your sister, if the dad has been fighting you for custody, he will probably go back to court if you do this. As the father, he would have priority over your sister for custody. It might be best to try and work something out with him before you do anything, if at all possible.
