Legal Question in Family Law in Maryland

Joint Custody and Relocation in MD

If I share joint custody, what is the maximum amount of distance I am able to move from the father? I heard it was 50 miles but I am unsure. Thanks.

There is no such rule. Sometimes in marital settlement agreements where the parties are sharing custody, they will put in a provision that requires them to live within a certain distance from one another, so that if one of the parents moves outside the distance, the remaining parent can demand that the moving parent give up joint custody.

I am assuming that the parties have not agreed to the matter in writing.

Since joint custody was granted in a Maryland court the judge will decide based on evidence as shown in the prior record. A material change in circumstance needs to be shown to modify a prior order.

Hardship which affects visitation may be considered to be a material change in circumstance.

If custody was awarded in another state you should contact an attorney in that state.
