Legal Question in Family Law in Maryland

Law student lies in divorce court

A law student, who has since passed the DC bar and is now a JAG officer in the US Army, lied in Maryland family court regarding the mandatory one-year separation required before divorce. The couple had only lived apart a few months prior to filing. The law student coerced his/her brother into lying about the couple's living arrangements when the brother appeared as a witness. Is the divorce legal? Should the Army be made aware of this?

If the divorce has now become final and the 30 day appeal period has passed, it is legal. If the spouse wanted to prevent the divorce, he/she could have presented evidence at the hearing refuting the false testimony. As to notifying the Army, that is a matter of your conscience, and how much trouble you want to cause this person. Make sure you know all the facts. It's possible to file for a limited divorce shortly after separating, and after a year from the separation date occurs, to amend the complaint asking for a final divorce.
