legal separation agreement

I am pursuing a legal separation from my husband. Must I sit down and decide on a separation agreement with my husband on various issues first before we can file such a settlement with the court? Or can I work with my lawyer to draw one up on my behalf and then work with my husband's lawyer on an agreement?

Why don't you follow your lawyer's advice as to how best to negotiate a settlement agreement? I always advise clients that if they are able to be civil with one another and work out the details, especially with regard to property division, they'll save time and expense then if they require all communication to go through the lawyers. In some cases, there's too much emotion and bitterness, and the parties just don't want to have anything to do with one another, even as far as dividing up personal property. These people end up paying their lawyers a lot more. So you should follow the procedure that works best for you.

It sounds to me as if your current attorney may not be providing your with the advice and counsel that you need. This said it is best to arrive at a mutual agreement as to property and other matters.
