Legal Separation

My husband has been in Korea for about seven months. I have not moved and have not filed for legal separation because of housing issues. I want to know if that this time can be used for the one year we have to be seperated to file for divorce. My husband is military and I have orders to show proof.

As long as there has been no interruption in the separation period, such as a home leave, you can count the time toward the one year separation. You will have to be able to establish through a corroborating witness that you consented to his departure, which shouldn't be a problem.
