Without the mother's consent it will be difficult for you to get custody, but you might be able to get a temporary guardianship. The problem is once it's revealed that you live in DC, which would eventuate from your filing court papers, your grandson won't be allowed to continue going to school in the county. Your best approach is to convince the mother to consent to a temporary guardianship. She might be persuaded to do this if she realizes that if she gets herself cleaned up and able to resume parental responsibility, she has prospects of getting her son back. If you get this far consult an attorney experienced in these matters to prepare the necessary documents.
