living with the father of my child, lived with him for over 3 1/2 yrs, have a 2yrs old, he has phcologically abuse me, my status in this country is illegal , he want to take my daughter

If you want to protect your parental rights you need to file a custody petition for your child. If you feel genuinely threatened that he may physically abuse you or your daughter, you can file a domestic violence petition which could result in the police removing him from the home. If you can't afford an attorney you need to contact the pro bono program through your county bar association.
