Legal Question in Family Law in Maryland

marital property in another state

my stbx took the equity out of our house and purchased a home in another state for his G/F, in her name only.

Can I go after her for fraudulent conveyance, she accepted the house knowing it came from marital monies.

What do you think the courts might rule as to this? I have documentation that the wire transfer came from my stbx's account 5 days after it was wired in from the equity loan he took from our house.

Re: marital property in another state

You don't have a claim against the g/f. But in the context of your divorce proceeding, you have a valid claim against your stbx for wasting marital assets and converting them to his own use. The divorce judge should award you an equivalent amount of marital assets to match what he took, and if there aren't sufficient assets to cover this, you should get a money judgment against him. With that judgment, you could attach his bank account, garnishee his paycheck, or try to attach other assets.
