is it marital property?

my stbx had money wired to a titling company in WV for the purchase of a home. But the home is titled in his g/f's name only. The money has been proven to come from the refinance of OUR marital home. I was told the house in WV is now considered marital property BUT what actions can the court take about the house since it's not titled in my stbx's name?

If your husband has used marital funds to acquire property in another state and in another person's name, there is a limit to what a Maryland court can do about the out-of-state property. What the court can do, however, is take the refinance and the property acquired through it into account when making a marital award in your divorce case. I strongly advise you to consult with an attorney about this issue as it is not a simple matter to deal with.
