Legal Question in Family Law in Maryland

i'm in maryland and my brother basically took his son from his soon to be exwife because her boyfriend thought it necessary to jump my brother in front of the child. My brother has filed for cusody and she did not contest it in the 30 time frame. He just went to his lawyer to file a motion for default custody. I also want to add that this fight happened on halloween of this year and it is now almost Jan 2011 and shes only came to see the child 3 times in the 3 months my brother has had him. Since she did not contest it in the 30 days will the judge give her a second chance and what are my brothers chances of gaining sole custody?
