Legal Question in Family Law in Maryland
maryland...I received a letter stating that my child support will be stopping when my son turns 18 tomorrow. He will not graduate from school until this year. My current support states that my ex-husband has to pay child support for the "minor children". Is the current law that provides support until high school graduation or age 19, retroactive for support orders established prior to the law going into effect? If not, would I be able to receive child support until he graduates from high school? If so, what would I need to do?

Your son is entitled to his father's support until he graduates from high school, so presumably that would be sometime this summer. The law was changed to extend beyond the 18th birthday up to graduation (not beyond 19) in 2002, and in 2007 the Md court held that the law was to be applied retroactively. You need to advise your ex of the law, and advise him that you will file a show cause order to hold him in contempt of court if he cuts off payments prematurely.
