Minor legal name change

My daughters ''father'' is not listed on her birth certificate, and she has my last name. I've been with my husband since she was 6 mnths. We would like to change her last name, my maiden name, to mine my husband and our daughters last name. Do I need her ''father'' who was abusive's consent if it's not his last name and he isn't listed on the birth certificate? Do you think we could get a judge to allow it or would her ''father'' have to be contacted?

The procedure is to file a petition for a name change in court. You'll be required to post a legal notice of the petition, which gives anyone who wants to object the opportunity to do so. Once the "objection period" expires, a judge will grant the request.

You should be able to accomplish on your own by going to your county's circuit court clerk and requesting forms. They'll usually answer all your questions and help you fill them out.
