Legal Question in Family Law in Maryland

modification of visitation

I was awarded sole legal and physical custody in Cina court in one county b/c mother had had children taken away but had then gotten them back but living conditions were horrible. she had a home study in one home and they okd it and gave mother every other weekend. since then she has been evicted out of her apartment and the living condtitions are back to the way she had. includes human solid waste. now social service case is closed b/c i have the child. i live in a different county. can i file for modification in the county in which i live? should i allow him to go when he is 3 and is terrified to go b/c of abuse and so on? I have witnesses? What should i do? So far she hasn't come to see him but the order hasn't been given in mail yet? Help!!!

Re: modification of visitation

You should proceed in the county that issued the current order if you're seeking modification--it will be easier than opening a new file; or you could ask the court in the original county to transfer the file to the county where you now live. If both of you now live in the same county they may do this.
