Modifying child support
My husband's income has dropped dramatically since his divorce. I can no longer work due to health problems. We would like to apply for a modification to lower the original child support order. Can this be done without an attorney? Our situation has us paying her half of the child support one week and the balance the next week. All the while she is threatening to contact the courts (we are only a few days late). I've heard such horror stories of people who have applied for lower child support only to have it raised that I'm reluctant to pursue this matter. Your help is appreciated. Thanks.

The family court (part of the Circuit Court) in your county has jurisdiction to reduce the amount of child support previously ordered if there has been a "significant change in circumstances" since the current amount was put into effect. A dramatic drop in your husband's income, through no fault of his own, would qualify. While it's possible to do this without an attorney, an attorney specializing in family law would know how to handle this best for you, and if the child is going to be entitled to support for a long time, it would be well worth it to invest the money to retain a lawyer.
