Legal Question in Family Law in Maryland
mortgage payment
My husband left our home and has been paying the mortgage for the past year. I understand that by law I can stay in the house for three years, my husband tells me that he is not required by law to pay the full mortgage he is only required to pay 1/2, is this a fact?

Re: mortgage payment
The portion of the mortgage for which your husband is responsible can only be set by an agreement you and he make, or by a court order. Your right to stay in the home during and after a divorce proceeding is only if you have custody of children who are not of age, and then only if you request exclusive use and possession of the home as part of the divorce proceeding, and the court grants your request.
If you file for divorce, you must request specifically the things you want the court to do, such as determine what property you own is marital, how it should be divided, and who should be responsible for paying joint expenses. That is why you should retain an experienced family law attorney to assist you.
