move son in with my boyfriend and i
I have a son his father was granted custody of him when he was 2. He has now and always wanted to come live with me he is now 12. I live with my boyfriend we have a very stable home and child together 1 of ours two of his and he has been seperated from his wife for over 5 years just not divorced. how much does any of this matter in the decision and how much does my sons opinion matter

When a court is presented with a decision to change custody, it must base it's decision on what is in the best interest of the child. It will consider the respective family living situations, the stability factor--which weighs against a change in custody, especially after a long time--and also the wishes of the child. However, while your son is old enough to express his opinion, it is only one factor in the process.
