Moving in with

My girlfriend just recently seperated from her husband in Maryland and has her on place. They have been seperated for about 4 months but we have been seeing each other for 9 months. Now she would like to move in with me in Delaware and I have a 3 bedroom house which they would have there own rooms. She is afraid he will get custody of there child if she does this. She can no longer afford to live on her on. Is there anything that would pervent her from moving in and what can he do to stop it. This is a very hateful man who has done nothing but threaten her with lies and never follows through.

If your girlfriend moves in with you, it could affect her ability to keep the child. The ultimate question in a custody case is what is in the best interest of the child. If the child is young, the court might consider it to be detrimental to the child if the mother is living in an adulterous relationship. On the other hand, if the child seemingly isn't bothered by it and bonds better with the mother, and the living conditions are equal or better, as well as schools and other facilities, she may be able to overcome it.
