Legal Question in Family Law in Maryland

moving out of state

i live in maryland. i want to move to washington state with my 12 year old daughter. her father hasnt been in contact with us for almost 2 years but im still legally married to him. do i need to notify him or his family that we are leaving? do i have to get a legal divorce? are there any strings that i need to be aware of because going thru with this move?

I assume you haven't been to court on this case and therefore don't have legal custody via a court order. While you don't have to get a divorce and it wouldn't be illegal for you to move to WA, I think you should notify him of your plans, to avoid the possibility of him trying to make a kidnapping charge. It doesn't sound like he is supporting the child. If you want child support, you can establish residency in WA and after 6 months file for support there.
