Not Named as Respondent
My sister has filed a Temporary Order of Protection on behalf of my son against his father who temporarily resides in my home. He does not have legal custody, I do and she did not name me as a respondent. Son is 16 and there have been physical altercations between them but they are old and were closed by Child Protection and Juvenile Services as being ''mutual disagreement, no fault by either party.'' Son was told to clean kitchen, got sassy with father and got yelled at; he then called my sister who took son and daughter to her house believing that there had been another physical altercation and filed the suit 2 days later. I have papers showing full legal custody granted to me in a court of law. In her suit she does not say mom has custody or anything, she says she wants dad to leave house or she wants permanent custody. Case is due to be heard Aug 11 at 9:30 a.m. What are my options as full legal custodial parent?

You can go to court and ask the court to dismiss the petition since you have legal custody.
