Legal Question in Family Law in Maryland

Please help

The NCP owes more than $10,000. The CS Order stated $579 Child Support and $200 extra for arears. He has been working under the table. I don't have pictures or know what company, if any, he is working for, but the NCP and his wife tell me ''he's on his way home from work'' ''He's working'' and things of that nature. He has visitation every other weekend, and on the Friday evenings that I drop them off, he has pulled up from work in his work van. Child Support ran the licence plate number to see if it was a company vehicle, and it is not. This is his personal van. His drivers license is suspended and his professional license is suspended as well. The have oders to intercept his taxes. He still drives to work every day, making money and won't pay Child Support. Everything is in his wife;s name - no bank account, cars, house, nothing. He will be going to a contempt hearing soon and I would like to know if I need beyond a reasonalble doubt proof that he is working, or is what they have said and what I have seen enough? What else should I testify to? Also, I have had to move from my rental becasue I couldn't afford everything, I have had my electricity cut off, Food Stamps and he refused to pay his 1/2 of the Summer Camps this past Summer.

If he shows up at the contempt hearing, he'll have to testify under oath as to the particulars of his employment. Then ask the judge or master to enter an earnings withholding order against the employer. This will require the employer to withhold the monthly amount from his check and send it to you. If he's found to be in contempt, or fails to appear, he can be incarcerated for nonpayment of support.
