Non-Custodial Father getting custody from Mother due to abuse from boyfriend

I have a friend (Non-Custodial Father) who is seeking custody from the mother; when

the father was with the mother one of the mother's other children (previous marriage)

informed him that the on/off again oyfriend had physically & sexually abused her.

The non-custodial father informed the mother; months went by and they seperated.

The non-custodial father learned that the mother was back with the abusive boyfriend

and approximately 1 year later the abusive boyfriend "obtained" 23 counts of sexual

& physcal abuse against 3 out of 4 of the mother's children.

The non-custodial father has tried to find out the extent of the abuse to his 4 year-old

son, but he has been denied by the court; his son is also in therapy for the abuse.

The mother has been charged & found guilty in the past for neglect due to leaving her

children in "inproper care that would put a child in harms way"- but she was 17 at the time.

Is there some law that pertains to a parent putting a child/children in harms way

(multiple times) that would help this father to gain full custody?

The Court must do what is in the best interests of the children. It sounds like the father must file for a modification and bring in all of the evidence regarding these incidents, including the kids if need be.

I would recommend seeking advise of counsel in this matter.
