under oath

when you are asked if you swear under oath that you will tell the truth, can you answer NO ? do you have to answer Yes ?

If you answer no you cannot testify. If your objection is religion-based, the actual oath is "do you swear or affirm under penalty of perjury".

If you refuse to take the oath and are there under a subpoena, you will probably be held in contempt of court for refusing to testify.
