Legal Question in Family Law in Maryland

obtaining info. illegially for a divorce

I had lived seperately from my wife for about 1 month when my wife used a key I had given her a yr ago to this property that I moved to from the seperation. The place is in my name only. I permanently moved out to this place. She went there without me knowing and went thru my papers and found out some financial information about my past business I had recently sold. She knew I had sold it and that's not the problem. I haven't even had a chance to disclose anything yet. We used a mediator. She kept bringing up the figures she admittingly found on my desk. This was where I was living and apart from her. She is threatening me because of the info she found. I have sense got my key back. Do I have any legal leverage at all for her doing this.. She doesn't believe what I did received for my business. I have shown papers but being an esop it is complicated and she insists I owe her much more. I am trying to avoid court for the business could be seriously hurt or taken bankrupt if the bank gets wind or involved in this process at all. She is using that as a type of blackmail and asking for two thirds of the total assets of everything. Do I have any leverage at all because of her sneaking in un invited to my place gathering info? thanks.

Re: obtaining info. illegially for a divorce

There is no legal basis to do anything but equal split of marital assets based on her going into your home and snooping. However, if the equal split is unequitable, then the Court could balance the inequity by giving a marital award.

I would be happy to discuss your matter further, if interested, please contact my office for a consultation.
