Parental kidnapping

My fiances ex left the state of Md with his daughter 6 months ago, we finally found out where she is (Tx). What steps can we take to get her back to md and possibly get custody of the child who is 4 years old.Is what she did kidnapping? As far as we know noone has legal custody of the child.

If there is no custody order in place, then no kidnapping occurred. If the child has been residing outside of Maryland for less than 6 months, then you would need to file a complaint for custody in Maryland immediately to establish jurisdiction in Maryland. If it has been 6 months or more, then the new state (Texas) would have jurisdiction.
