Legal Question in Family Law in Maryland

Ex Parte

Is an Ex Parte valid in only the State it was issued, in this

case, Maryland, or if a problem occurs in a neighboring State, like Virginia or Delaware... is it a violation of the ex parte?

Thank you

Re: Ex Parte

I assume you're referring to an ex parte civil protection order. A MD order will be violated even if the violation occurred outside of MD. By the way, the "ex parte" refers to the preliminary order you got when you filled out the petition and went before a commissioner or judge, and was subject to a further evidentiary hearing in about a week, at which both parties participate or are entitled to do so. If you've reached that stage, you should have a civil protection order by now.

Re: Ex Parte

You need only show proof of the violation before a Maryland court to prove a violation. Only after getting a civil protection order will a judge put him in jail.
