Partial custody and child support

If I file for partial custody where the kids live with me six months and they live with their father for six months of the year. Would either of us be responsible to pay the other child support when we share the same amout of time with them caring,and providing for them in a loving enviroment.

A parent's child support obligation under MD law is based upon his/her income. Even though the children would spend equal time with each parent, the parent who earns the greater amount of money would, under the child support law, be obligated to pay support to the other parent. There is a rather complex formula for determining the amount of support that would be due, and I suggest you contact a family law attorney or go to the child support enforcement office at the circuit court in your county to have them compute the amount. You'll need to know the father's current income and, if he pays for their health insurance, the amount of the premium. Another factor is the amount of any child care expenses you are incurring.

As Mr. Sher indicated, child support is pursuant to the Maryland Child Support Guidelines and 12-204 of the family law article. In most cases, the parents make a similar amount of income, therefore, each party would be generally responsible for the support of the children. Furthermore, the court, in the best interests of the child, can deviate from the guidelines.
