Paternity test
I had a child 8 yrs ago by another man, my husband put his name on the birth certificate and claims her as his own. I am being served by the other man wanting rights to see her and have a paternity done, he lied on the court paper stating he has looked for me for 8 yrs and he hasn't I have been right here. Do I have to do the paternity? I have not been served yet, they can't locate me to serve me.My daughter wants nothing to do with him and neither do I.

If he never formally gave up his parental rights he will probably be entitled to a paternity test, and thereafter if he tries to assert paternal rights you would have to oppose them in court. The courts are loath to deny paternity rights, but ultimately will do what they feel is in the best interest of your daughter.
