Legal Question in Family Law in Maryland
paying 1/2 for braces...
I lost custody, both physical and legal, of my daughter in 2003. Her father took her and his new family and moved to Florida. I pay a monthly child support payment, but her father just sent me a ''heads up'' e-mail to let me know what the cost of braces would be and what I would be responsible for!
My custody order says nothing about the medical costs, my first child support order said we would split uncovered medical expenses 50/50, but my latest child support to modify amount says nothing about being responsible for these costs.
Please understand, it's not that I don't want to take care of my child, it's that I am financially unable as I only receive a small income from Social Security based on disability. My ex-husband however, makes about 8 x more per year and did not pay for 1/2 of anything when my daughter lived with me.
What do I do? Am I indeed responsible to pay 1/2?

Re: paying 1/2 for braces...
Your latest child support order may have language that says that the previous order remains in effect as to all terms not specifically changed by the second order. If so, you would be liable for half the cost of the braces. But given your situation, you could file a court petition asking the court to make him pay most of the costs since he makes so much more than you. If you don't have or can't afford a private attorney, contact the bar association in your county and ask about their pro bono (free lawyer) program.
