Legal Question in Family Law in Maryland

Payment responsiblities

I have had physical custody of my son since he was born. His father and I were never married. I recently got married to a man in the military and moved out of state with out any resistance from my son's biological father. Now he says its my responsiblility to pay for all his travel cost because I chose to move and he pays child support. Is this true?

Re: Payment responsiblities

The responsibility for this expense is subject to agreement between the parties or, if they cannot come to an agreement, could become the subject of a court proceeding. Since your move was necessitated by your husband's career, I think a fair solution is for the 2 of you to split this expense. The fact that he pays support is not really relevant. If he refuses to share the cost, ask him if he's willing to resolve it through mediation or binding arbitration, which will cost you a few hundred dollars. If he refuses, tell him you'll book transportation for your son for the visitation when he sends you half the cost.
