Legal Question in Family Law in Maryland
Post Divorce Rights
Since 1996 I have been living with my ex-husband from whom I was divorced in 1978. We had been dating since 1990 and we were in love again and planned to be remarried or I would never have moved in him. He now tells me he wants to live alone. Our separation agreement stipulates that alimony ceases if I remarry or cohabitate with ''any man.'' My ex-husband, therefore, says that the separation agreement is null and void. Can this be so? In addition, can he ''evict'' me?

Re: Post Divorce Rights
A separation agreement can stipulate whatever terms the
parties agree. Alimony in Maryland has lost considerable
steam due to gender liberation. Nonetheless, your agreement
may still be valid. He cannot use what appears to be pretense
to obviate his responsibilities under a valid agreement. The term
"any" may be being misapplied. You may have an action and an attorney
can help you.
As for eviction, you have not provided enough information. What is the property and
how is it titled? To whom is it titled?
