Legal Question in Family Law in Maryland

Power of Attorney

My daughters father left for bootcamp a few weeks ago and allegedly left power of attorney with his wife. Does power of attorney authorize her to make legal decisions concerning child support, visitation, and/or custody?

Re: Power of Attorney

If your ex has sole legal custody of the child, either by agreement with you or a court order, then the wife can use a broadly drawn power of attorney that way, except she can't restrict your visitation rights or the child support obligation. You could certainly seek custody under the circumstances, and would have priority as the biological parent. If you already have custody, the stepmother has no greater rights than what your ex had.
