Question:
what happends if spouse leaves wife because he is having affaiar. Not legally seprated haven't been to court yet. But he has bought another home with your knowledge and furiture. Also has not really given you much child support for you and 3 small children?

If the home was purchased with money derived from the husband's income, it's marital property and you are entitled to a share of it. You can file for divorce based upon adultery and ask the court to award you custody of the children, order the father to start paying support, and to divide the marital assets. This would also include the value of any retirement plans or accounts. You should see a family lawyer for this, but if you can't afford one, you can go to the child support office in your county and ask them to go after the father for the child support.

The home he has purchased is part of the marital property which means you are entitled to some of its value. Was there a separation agreement describing how property would be treated between the time you separated and the expected date of your divorce?
