Protective Order

Hello. I got a domestic violence order against me on 11/13/07. The judge ruled in her favor, and it lasts until 6/13/08. My first question is: How can it be domestic violence when I never hit her, and we never lived together? Second question: I told her I would contact her on 6/14/08. If I would do that, can I be charged again since the order is expired? Thank You.

A judge can enter a civil protection order based on evidence which supports a finding that the complaining party is in reasonable fear of being assaulted by the respondent. In other words, there does not have to be proof of an actual physical assault to justify the "stay away" order. Also, you don't have to have been living with the complaining party in order to be subject to the order. If you were present at the hearing on the 13th, the judge should have explained all of this to the parties in his/her ruling.

As to your second question, the order expires on 6/13/08, so unless it is extended, you are not prohibited from contacting her at that time.
