Divorce MOU says he gets half my 401 and I get half of his, however I only worked 6 of our 26 years of marriage. My attny ''accidentally'' wrote QDRO giving me half of his 401, but not giving him half of mine (divine intervention). His attny signed off, my attny signed off and judge signed off back in 4/09. Can he amend this or am I just lucky? He wants to take ''judicial'' action. Does he have a leg to stand on?

The intent, as expressed in the documents, may be modified should a judge decide based on equitable argument, mistake or otherwise. He should have raised his objections within 30 days of the judicial order.
