Legal Question in Family Law in Maryland
Was he raped?
If a 21 year old female has sex with a 14 year old boy, is this considered rape? My friend was told he would be a father at the age of 16. The woman started ''messing with the child'' when he was about 13 or 14 years of age. The female regarded him as her ''boyfriend'' and the boy did not consider her as anything but his father's friend. Was this rape?
Now, she wants child support from this boy. He is only 19 now and just began working.
I think the state of Maryland should file charges against her. She did NOT use the real father's name on the birth certificate for fear of being charged with a criminal offense. She put another males's name on the birth certificate.
The father of the child is racially mixed, and the mother is caucasian. She refuses to write the child's race as ''African-American (which he is). Help! Any advice or answers?

Re: Was he raped?
A 21 year old who has sexual intercourse with a 14 year old is guilty of a third degree sex offense, punishable by up to 10 years in prison. It would be up to the boy to file charges, and since it's 5 years later, the state's attorney may elect not to prosecute. As to child support, if he voluntarily engaged in the act, he may be responsible for it now that he's an adult. The child is entitled to the support of both parents under MD law.
