Legal Question in Family Law in Maryland

Real Estate Property

I am separated, for 5 months, I owned my house before marriage. I have to wait a year to apply for divorce in Maryland. I want to take loan out to pay off car and do home improvements. Will my husband have any part in this financial request.

Re: Real Estate Property

If you remain sole owner on the deed, and can qualify for the loan on your own, your husband shouldn't be involved in taking out a home loan or equity line. However, you need to understand that if you've been paying on a mortgage during the marriage, presumably from your earnings, you've created a marital component in the property which will be subject to distribution at the time of divorce, unless you and your husband can work out a separation agreement.
