Recovering Child Support Arrears

I am a custodial parent with a child support order of which the non-custodial parent is in arrears over $13,000. He order is for $525 per month, he pays $414 per month which means monthly the amount he is in arrears increases. How do I recover the arrears if he continues to pay monthly? At this rate he will always owe me!

Your options include: garnishment of wages and/or unemployment benefits, offsets to Federal and State tax refunds for arrears, reporting arrearage under judicial order to credit bureaus, having the Motor Vehicle Administration suspend a driver�s license, bringing contempt of court action(s), possible Federal prosecution for interstate avoidance, and/or using a private collection service. You can file a contempt proceeding and or a more risky move would be to file for a modification. Either way, the court can then increase the arrearage payment to assist in repayment.

In Order to recover,you must file an appropriate Motion for relief in the Court from which the Support Order was issued. If he is a W2 employee, it will be easier to garnish/wage withhold his pay directly to you. The process is complicated and an attorney will be very helpful. (301) 279-8773.
