Legal Question in Family Law in Maryland

Reduction of Child Support Payments Based on Subsequent Children

I have a child support order that was established

2 1/2 years ago and NCP has never paid anything on it yet. MD's CSE office is handling the case and taking their mighty old time, even though they know his place of employment. Anyway, even though all of this is occurring my ex is threatening to get the order reduced because he had 3 other children by 2 other women after my daughter was born. My daughter has the first, and only, child support order against him. I wanted to know if he can get the order reduced based on his other children? (IF he does begin paying?)

You are entitled to full payment on the order. Any

reduction that is threatened is just that...a threat.

Call me and have this matter addressed. My fee is considerably

less than the rest, but my service with child support orders it the best.

Re: Reduction of Child Support Payments Based on Subsequent Children

The father of your child cannot get a reduction in court-ordered child support on the ground that he has fathered other children whom he is not supporting. He could get a reduction if he were paying child support for those children, but since his total child support obligation would be significantly greater for all of the children he should be supporting, he is not likely voluntarily to look for an order from the court that he provide such support.
