Removing child from state

Does the removal of a child, by the custodial parent, to the city of Virginia Beach,Va. without notifying the non-custodial parent, who has a court order specifying his visitation hours, constitute kidnapping in the state of Maryland?

Re: Removing child from state

No. But it may violate the terms of the custody and visitation order, and if so, would subject the custodial parent to a contempt citation. If the order is silent, and the effect of the move is to interfere with your visitation rights, you may have to file a motion to modify.
