Renting the House

Hi,

we are not legally separated yet, but living separately. i have 2 kids 13 and 10. he is not giving any money to support my kids. i moved out recently from the house because of the safely problem from the house. my husband moved into the house and renting the house without telling me. the house is jointly owned. he is renting for 3 people i heard they pay cash not through lease.

in this case what i can do, to get the money for my kids also what are the consequences if doesnt pay any support and renting the house for him?

You refer to the children as "my kids", but I'm assuming they are his as well. If so, you need to immediately file a petition for custody and child support. You could do this separately or as part of a petition for limited divorce. He will be ordered to produce income documents, and that would include the rent he's receiving from the "tenants" in your house. The amount of support he's going to have to pay will be determined from the MD child support guidelines and is based upon his income and any you have. You should immediately consult a family law attorney who can assist you with this.
